Clarification of the Agency regarding social benefits in the election campaign

The Law on Financing of Political Entities and Election Campaigns prescribes prohibitions, restrictions and reporting obligations for the purpose of transparency in the use of public resources in the election campaign.

Article 40 of the Law prohibits state and local consumer units from paying, i.e., giving one-time financial assistance, in accordance with the law regulating the rights and performance of activities in the area of social and child protection, except in the case of the death of a family member, a serious illness that causes permanent disability in a percentage greater than 50% or damage to a residential building or property due to fire or natural disaster.

The prescribed prohibition does not apply to other material benefits that are paid in accordance with the Law on Social and Child Protection.

The prescribed prohibition does not apply to the payment of one-time benefits to employees under Article 26 of the Branch Collective Agreement for the field of culture and Articles 23 and 24 of the Branch Collective Agreement for the area of ​​administration and justice.

Local budgetary spending units are prohibited from monthly spending more than 20% of the average monthly consumption for these benefits in the third quarter of the previous budget year in terms of material benefits from social protection under the jurisdiction of the local self-government unit, in accordance with the law regulating the rights and performance of social and child protection activities.

Municipalities collect data on the distribution of all forms of social assistance at the local level during the election campaign, including data on the type, amounts and recipients of social assistance, and submit it to the Agency on a seven-day basis.

As the pandemic of the infectious disease COVID 19 is still present, in accordance with the Law on the Protection of Citizens from Infectious Diseases, the prohibition of the payment of social benefits from the current budget reserve does not apply.
