Competences of the Council

The Council of the Agency for Prevention of Corruption has five members who are elected for a period of four years and may not be elected more than twice. The members of the Council are elected by the Parliament of Montenegro on the proposal of the working body responsible for anti-corruption affairs.

The Council, pursuant to Article 88 of the Law on Prevention of Corruption ("Official Gazette of Montenegro, No. 53/14"),

The Council works and decides at sessions which are generally held twice a month. A session of the Council may be held if more than half of the members of the Council are present, and decisions are made by a majority vote of the total number of members of the Council. The decision on the election and dismissal of the Director of the Agency are be made by the Council by a majority of at least four votes.

The work of the Council is coordinated by the President, who is elected from among the members of the Council, for a period of one year. President of the Council: signs decisions of the Council and other acts within the competence of the Council, takes care of the organization of the Council, takes care of the execution of decisions of the Council, prepares and convenes sessions of the Council, proposes the agenda in agreement with members of the Council, and chairs the sessions, initiates the procedure for election and dismissal of the Director of the Agency, takes care of the implementation of the Rules of Procedure of the Council and other rules, initiates professional meetings and chairs them, gives statements to the media on activities related to the Council, performs other affairs determined by law and these Rules of Procedure.

The publicity of the work of the Council is achieved by sending press releases to the media about matters within the competence of the Council. Representatives of the media (journalists, cameramen and photo reporters) may attend the sessions of the Council, according to the previous decision of the Council, and in accordance with the provisions of the law. The Council also informs the public about its work through press releases, publishing decisions on the website or in other ways.

  • announces a competition for the election of the Director of the Agency,
  • elects and dismisses the Director of the Agency,
  • adopts the Statute and the Act on the internal organization and systematization of the Agency's workplaces, at the proposal of the Director of the Agency;
  • at the proposal of the Director of the Agency, adopts the annual work plan of the Agency;
  • on the proposal of the Director of the Agency, adopts proposal for the budget and statement of accounts of the Agency;
  • at the proposal of the Director of the Agency, adopts the rules on the work of the Agency and the rules for the preparation and implementation of integrity plans;
  • adopts the rules of procedure of the Council;
  • gives initiatives to the Director of the Agency to improve the work of the Agency;
  • upon the proposal of the Director of the Agency, adopts the Annual Report on the work of the Agency;
  • checks the data from the report on income and assets of the Director of the Agency;
  • performs other duties determined by the Statute of the Agency.
