The Agency to start with field controls

To improve the transparency and integrity of the election process, the Agency started conducting field activities to provide for the detailed and comprehensive control of the financing of the election campaigns and to monitor compliance with the provisions of the Law on Financing of Political Entities and Election Campaigns during the Local Elections Campaign in the Royal Capital of Cetinje and municipalities of Mojkovac, Petnjica and Tuzi, a municipality within the Capital City.

The plan is to subject 17 government authorities and five political entities to control. The final number of controlled entities will be known after all political entities that intend to run for the elections at the City Assembly of the Royal Capital Cetinje and the assemblies of the Municipalities of Mojkovac, Petnjica and Tuzi, a municipality within the Capital City, submit the electoral lists to the Municipal Election Commissions.

The Agency’s first field activities were carried out to monitor compliance with the provisions of the Law on Financing of Political Entities and Electoral Campaigns in the public institution KIC Malesija, while the next control was scheduled in the premises of the Municipality of Tuzi, a municipality within the Capital City. The Agency will compose a report about these activities, as well as control activities undertaken in the institutions in the territories of the municipalities of Mojkovac, Petnjica and the Royal Capital of Cetinje.

The implementation of control activities by the Agency is foreseen under the Control and Supervision Plan of the election campaign for the election of councilors in the Assembly of the Royal Capital of Cetinje and the assemblies of the municipalities of Mojkovac and Petnjica, as well as the Control and Supervision Plan of the election campaign for the election of councilors in the Tuzi Assembly, a municipality within the Capital City, which will be held on November 26, 2017.

The field control activities of the Agency involve the examination of documentation, i.e. direct insight into business books, bookkeeping and other documents of a political entity, authority or other entity that is the subject of control, and the control thereof.

In addition to the implementation of field activities, the Agency monitors the implementation of the Law through continuous follow-up and analysis of reports, information and data on the operations and activities of entities regulated by the Law, delivered regularly on a seven-day or fifteen-day basis during the election campaign, or at the request of the Agency.

Where in the implementation of the control or supervision, the Agency obtains data indicating irregularities or violations of the law, the Report on the performed control or supervision will be made within 15 days from the date of the irregularity or violation of the law established, and a deadline will be set to amend or supplement the documentation, or otherwise a misdemeanor procedure will be initiated, pressed a charge or brought an initiative before the competent authority for further action.

In case of complaints, the Agency will proceed to determine the facts, circumstances and allegations contained in the report through a statement or insight into the documentation of the subject of the report, i.e. act upon all submitted complaints in accordance with its competencies. The Agency will notify the public in a timely manner about all the results of the activities conducted during the election campaign.
