Announcement on the obligation to make a decision on the amount of budget funds for political entities in 2022

Recognizing the need for proactive action, the Agency for Prevention of Corruption reminds that the Ministry of Finance and Social Welfare and local government bodies responsible for finance are obliged to make a decision by January 31st on the amount of budget funds allocated to each individual political entity to finance regular work in 2022. year, and to publish it on its website within seven days from the date of its adoption.

The Agency also reminds of the legal provision that budget funds for financing the regular work of political entities in the Parliament of Montenegro amount to 0.5% of the planned current budget of Montenegro in the year for which the budget is adopted. 1.1% of the planned current budgets of each individual local self-government unit have been allocated by law to finance the regular work of political entities in the municipal assemblies, the Capital City Assembly and the Royal Capital Assembly. Exceptionally, in municipalities with a budget of less than five million euros, budget funds for financing the regular work of political entities amount to 1.1 to 3% of the planned current budget.

These budget funds in the amount of 20% are distributed in equal amounts to political entities that won seats in the Parliament of Montenegro or municipal assemblies, and 60% is distributed in proportion to the total number member of parliament or councilors seats held by political entities at the time of distribution. 20% is distributed in equal amounts to political entities in the Assembly, i.e. municipal assemblies, in proportion to the number of elected representatives of the underrepresented gender.

We remind you of the obligation to regularly allocate budget funds to a political entity to finance regular work, monthly, by the fifth of the month for the previous month (Articles 13, paragraph 8 and 14, paragraph 7 of the Law), as well as the legal obligation to publish on its website by the fifth of the month for the previous month, the estimated amount of funds as well as the amount of outstanding funds to political entities. The obligation refers to the funds provided for the regular work and financing of women's organizations that are distributed to political entities (Article 13, paragraph 9 and 14, paragraph 8 of the Law).

Failure to comply with these legal obligations entails misdemeanor liability.
