Notice for political entities that will participate in the elections on October 23

Political entities are obliged to open a special bank account for collecting funds and financing election campaign expenses, before the start of the election campaign activities defined by law, and no later than the day after the day of confirmation of the election list.

Based on the competences prescribed by the Law on Financing of Political Entities and Election Campaigns, and with the aim of complete transparency of the electoral process, the Agency for Prevention of Corruption performs essential control of the activities, collected and spent funds of political entities in the campaign.

In the current course of the campaign for the local elections that will be held on October 23, 2022, the Agency recorded the activities of political entities, including those who did not open giro accounts.

For this reason, and acting proactively, we inform the political entities that will participate in the elections about their obligations prescribed by the Law.

Political entities are obliged to open a special bank account for collecting funds and financing election campaign expenses, before the start of the election campaign activities defined by law, and no later than the day after the day of confirmation of the election list. The political entity determines the responsible person for the purposeful spending of funds and submission of reports. The subject informs the Agency about opening a giro account and determining the responsible person within three days.

In addition, political entities are required to submit to the Agency:

- fifteen-day reports on contributions of legal and natural persons (September 19, October 3 and 17, as well as November 1, 2022),

- report on media advertising in the election campaign (October 17),

- interim report on campaign expenses five days before the election day (October 18),

- report on funds collected and spent during the election campaign, with supporting documentation (November 22).

Failure to open a special giro account and failure to submit reports affects the transparency of the election process, raises doubts about the illegality of collecting and spending campaign funds, and leads to misdemeanor liability.

Dedicated to the protection of the public interest, the Agency will carefully monitor the execution of the aforementioned obligations, continuously provide subjects to the Law with guidelines and opinions regarding the application of the law.
