WORKING TOGETHER - STATE BODIES
• As per the Innovated Action Planfor the implementation of the Programme for fight against corruption and organised crime (May 2008), the Police Directorate and the Directorate for Anti-Corruption Initiative have been charged with promotion of the Technical Instruction on procedures for reporting corruption crimes and protection of the persons who report those crimes to the Directorate of Police. The Instruction was adopted by the Director of the Directorate of Police in October 2008.
In order for the Instruction to be efficiently enforced, in November 2008, the OSCE Mission to Montenegro organised a training seminar aiming to promote the Instruction and provide guidelines for its successful implementation, and the special training for police officers who would be in charge of receiving corruption complaints in all the territorial units of the Directorate of Police, and for the representatives of Directorate for Anti-Corruption Initiative.
Since the adoption of the Technical Instruction, the Directorate of Police and the Directorate for Anti-Corruption Initiative have organised several promotional campaigns, in cooperation with the OSCE Mission to Montenegro, including the intensive campaign Report corruption, the rest is our responsibility. The campaign involved information material, TV advertisement, flyers distributed via print media and billboards throughout Montenegro. Following the promotion of the Instruction, the representatives of the Directorate of Police and the Directorate for Anti-Corruption Initiative have participated on TV and radio shows, while this piece of secondary legislation has also been promoted in the internal bulletin of the Directorate for Anti-Corruption Initiative Anti-Corruption and in educational sessions for university students, under the anti-corruption campaign Corruption must not be the way out, conducted by the Directorate for Anti-Corruption Initiative.
• Within the project entitled Education of Public Officials on Conflict of Interest, the representatives of the Directorate for Anti-Corruption Initiative took part in the seminar on Introduction of the new Law on Prevention of Conflict of Interest – Novelties in the Law. The seminar was organised by The Monitoring Centre – CEMI, for media representatives. On that occasion, the most important changes and novelties in this anti-corruption law were presented to the media representatives.
• The Directorate for Anti-Corruption Initiative, in cooperation with the Commission for review of objections, complaints, proposals and suggestions of citizens and other entities in the privatisation process, designed the Brochure on reporting corruption in the process of privatisation. The brochure aims to introduce the corruption crimes to the parties in the process of privatisation and to other stakeholders, as per the Criminal Code of Montenegro and the Article 18 of the Law on Courts, methods of privatisation, invisible forms of corruption, methods of preventing corruption in the process of privatisation and methods of reporting corruption crimes. The brochure was printed in 2000 copies and submitted to the Commission for further distribution.

WORKING TOGETHER - NGO sector
• Within the project Fight against Corruption in Education, in cooperation with the Centre for monitoring (CEMI), representatives of the Directorate for Anti-Corruption Initiative participated in an anti-corruption campaign for secondary school students. The campaign workshops were held in secondary schools in the following Montenegrin towns: Podgorica, Danilovgrad, Niksic, Herceg Novi, Kotor, Tivat, Budva, Mojkovac, Ulcinj, Bijelo Polje, Kolasin and Berane.
During 90 minutes of interactive work with CEMI’s trainers, the students learnt about the concept and definition of corruption, examples of corruption in education, its causes and consequences, goals, and victims of corruption. Representatives of the Directorate presented the measures the Government undertaken to combat corruption. On that occasion, the Anti-corruption guide for secondary school was promoted and distributed. This brochure, prepared with the financial support of the Foundation Open Society Institute and expertise of the Bureau for Education, is adapted with its content and design to the secondary school age and introduces the criminal offences of corruption, the most common examples of corruptive behaviour in education, its negative consequences and the need to combat it.
Within the same project, a representative of the Directorate held a lecture for secondary school teachers on the Innovated Action plan for implementation of the Programme for the fight against corruption and organised crime, which provides for an active involvement of general public, civil society and media in its effective implementation.
•Within HOPE Fellowship Program, implemented by the Centre for Monitoring - CEMI, the National Albanian American Council (NAAC) and the Directorate for Anti-Corruption Initiative, public presentations on combating corruption were held in Tuzi, Danilovgrad and Ulcinj. The project aims to strengthen the fight against corruption at the local level, thus the lectures were attended by local government employees and officials. On this occasion, the representatives of the Directorate promoted Technical Instruction on procedures for reporting corruption crimes and protection of the persons who report those crimes to the Police Directorate.
• In order to raise awareness about the problem of corruption, the Directorate, with the financial support from the Foundation Open Society Institute, Representative Office Montenegro, published the "Anti-corruption guide for secondary school" in Montenegrin and Albanian languages and distributed it to secondary school students from "Slobodan Škerović“ in Podgorica and secondary school students from "Petar Petrovic Njegos” and "25 Maj" in Tuzi. The guide includes a brief description of the offenses of corruption, with special focus on corruption in education, and the info on state bodies competent to adjudicate reports of citizens. The guide was distributed during the anti-corruption campaign at universities and students' homes in the municipalities of Podgorica, Kotor, Cetinje, Bar and Berane.
• The Directorate for Anti-Corruption Initiative and NGO CEPRIM, in cooperation with the Ministry of Education and Science, started a new anti-corruption campaign called "Anti-Corruption Initiative 2009-2012”. Representatives of DACI within the campaign in Montenegrin secondary schools hold lectures on "What is corruption”.
WORKING TOGETHER - Private sector
• In cooperation with the Union of Employers of Montenegro, the Directorate designed the brochure The participation of the private sector in combating corruption, which contains definition of corruption, overview of criminal acts of corruption, important provisions of the Law on Liability of Legal Persons for Criminal Offences, consequences of corruption, and what entrepreneurs can do in fight against corruption, as well as how to report corruption. The brochure was distributed to the members of the Union of Employers, diplomatic and consular missions to Montenegro, international organizations and state bodies.
Representatives of the Directorate and the Union of Employers promoted the brochure on the participation of the private sector in combating corruption in Montenegrin via electronic media as well.
WORKING TOGETHER – International partners
European Commission
The implementation of the project Fight against corruption and organised crime, financed from the European Union Pre-Accession Assistance (IPA) began in February 2009. Besides the Directorate for Anti-Corruption Initiative, the beneficiaries of the project include the Police Directorate and the Directorate for Prevention of Money Laundering and Terrorism Financing.
The twinning partner in this project is the United Kingdom, while the objectives of the activities relating to the DACI are:
• Selected legislation review and strengthening DACI’s capacities for provision of legal advice;
• Strengthening inter-institutional cooperation,
• Strengthening DACI’s capacities for activities aimed at public awareness raising.
Government of the Kingdom of Norway
In 2009, DACI implemented the project Support to the implementation of international anti-corruption standards and instruments in Montenegro. The project was funded the Royal Norwegian Ministry of Foreign Affairs, and implemented with the support of the International Management Group (IMG). The project activities included the research on corruption from the perspective of the private sector - Analysis of the presence of corruption and barriers to business in the relationship between the public and private sector in Montenegro. The research, conducted by the CEED included respondents from over 320 companies and state institutions. Under the same project, the DACI organised a Seminar on liability of legal persons for criminal offences, and tracing, seizure and confiscation of assets.
In August 2009, DACI has been granted funds for the project Strengthening the operational capacities of the Directorate for Anti-Corruption Initiative of Montenegro. The project is aimed at enhancing the process of reporting to the National Commission.
UNDP Office in Podgorica
UNDP is the main international partner of the Directorate. Earlier joint projects were mainly focused on the harmonization of Montenegrin legislation with the United Nations Convention against Corruption (UNCAC). In light of the Memorandum of Understanding, signed in December 2008, between the United Nations Office on Drugs and Crime (UNODC) and the United Nations Development Program (UNDP), the UNODC's experts analyzed four Montenegrin laws: Law on International Legal Assistance in Criminal Matters, Law on Liability of Legal Persons for Criminal Offences, Law on Financing Political Parties and Law on Free Access to Information, regarding their compliance with the requirements of the UNCAC provisions. The analyses include specific recommendations for the implementation of the Convention.
UNDP is the main partner of the Directorate in organising research activities. Up to date, two researches (judiciary and local self-government) have been conducted applying UNDP and UNODC developed methodology. The preparation of the research on corruption in public administration is ongoing.
The research on Integrity and Capacity Assessments of the Judiciary in Montenegro (October 2008) was implemented by the Centre for Entrepreneurship and Economic Development (CEED) in Podgorica, for the needs of the UNDP Country Office and the Directorate, and in accordance with the UNODC standards. The research included respondents in 19 Montenegrin municipalities, while the results confirmed the objectives of the judiciary reform in Montenegro.
The research on Integrity and Capacity Assessments of the Local Self Government in Montenegro *June 2009), conducted by CEED, for DACI and UNDP, included 21 municipality, 5 focus groups (citizens, business sector, local self government employees, civil sector and the employees of the Ministry of Interior Affairs and Public Administration (Local Self Government Sector)). The research instrument used with the first three target groups was direct interview, while with the remaining two target groups it was in-depth interview. The comprehensive analysis of the integrity and capacity assessments of the local self government included several segments of functioning of these bodies, such as the quality and availability of services, local government efficiency, corruption, and the relation between local self government employees and citizens. The research contains a number of recommendations to be used as a basis for drafting local anti-corruption action plans.
In cooperation with the UNDP Office in Podgorica and the UNDP Regional Centre in Bratislava, the Directorate took part in the project Network of Experts against Corruption (ACPN). After a number of preparatory activities, the project resulted in the DACI Capacity Assessment, now the baseline for the DACI’s capacity enhancement. The priorities identified the assessment include trainings in the area of strategic planning at both national and organizational level, statistical literacy and research methodology and instruments, as well as communication with media, and design and implementation of the targeted campaigns.
OSCE Mission to Montenegro
The ongoing project Anti-Corruption Initiative in Montenegro entails education trainings for procurement officers in the local self-government units. It includes 3 regional seminars and a final conference in Podgorica.
The Directorate and OSCE Mission to Montenegro prepared a project aimed at further strengthening of cooperation with private sector in fighting corruption. The project integrated two recommendations GRECO evaluated as partially implemented; the elimination of barriers to business and instructions for state auditors on the procedure for reporting corruption to the state prosecutors. As of July 2009, the DACI and the representatives of the Council for the elimination of barriers to business, the Ministry of Economy, Ministry of Spatial Planning and Environmental Protection, Union of Employers, the Chamber of Commerce and representatives of the private analyze the existing legislative and institutional framework for business activity. To date, special reference was given to the issuance of building permits.
Council of Europe
Globally, the cooperation with Council of Europe is implemented through the membership of Montenegro in the Group of States against Corruption (GRECO). In cooperation with the Council of Europe’s country office, the Directorate organises events aiming to promote Council of Europe’s Criminal Law Convention on Corruption and Civil Law Convention on Corruption.
WORKING TOGETHER – Donor Coordination
Support of numerous donors was significant in the previous period, and laregely aimed at establishing legislative and institutional framework. The need to avoid overlapping of activities of both donors and competent state bodies, and aspiration to achieve the best possible results in fighting corruption, led to the organisation of the first donor coordination meeting in this area.
First donor coordination meeting in the area of anti-corruption policy held on 19 June 2009 was organised by the Directorate for Anti-Corruption Initiative, and hosted by European Commission Delegation in Podgorica.
